Progressive achievements
In conrast to the doom and gloom of climate change reporting, many positive policies, actions and commitments have been made around the world in recent years. Central to these is a recognition that we are inately connected to our planet and its ecosystems which support us.
Bolivian Declaration of Mother Earth Rights- 22nd April 2010- catalysed by the failure of Copenhagen Summit to provide a binding agreement and include the public in the process, Bolivia hosted a world peoples conference and adopted a Declaration for Mother Earth Rights.
International Crime of Ecocide- Polly Higgins calls on the United Nations to recognise mass destruction of ecosystems as a 5th international crime against peace.
Ecuadorian Constitution: The first constitution in the world to recognise the rights of Nature (Pacha Mama).
World Charter for Nature-1982: serves as a moral code of action, recognising every form of life on Earth has intrinsic value.
Case of Grainger PLC & Others v T Nicholson: 2009: The philosophical belief in man-made climate change was given equal status as a religious belief.
Open Space Case, U.S: Public nuisance laws asserted in order to bring a lawsuit against the 5 largest emitters of Greenhouse gas in US.
Massachusetts Case, U.S: The Supreme Court ruled that the Environment Protection Agency must regulate emissions of greenhouse gases including carbon dioxide from motor vehicles, under the Clean Air Act.
Scotland Climate Change Act: A groundbreaking legislation placing climate change duties on public bodies to reduce emissions by 80% by 2050 and mitigate impacts.
People’s Declaration from Klimaforum09: Coming out of the people’s alternative to the Copenhagen summit, the Declaration calls for a transition towards a future that ensures rights of life and dignity of all peoples and environment.
Heathrow Case-26th March 2010: Milestone judicial ruling requiring that the Climate Change Act must be taken into account within aviation planning policy.
Ombudsman for future generations- 2007: Hungary appointed a parliamentary commissioner for future generations- with wide powers the environment and sustainability come to the fore.
Belize Coral Reef- 2009: Viewing the Mesoamerican reef as a living being, the chief justice ruled the shipping company to pay liability costs of $11 million Belize dollars.
Minors Oposa Case, Philippines: The court ruled in favour of the rights of future generations to have a clean environment in accordance with the rhythm and harmony of Nature.
